In 2004 Cyprus passed the Real Estate Law 273(1) 2004 relating to Cyprus estate agents. In terms of this law the estate agent is obliged to take out and maintain a professional liability insurance for the maximum sum of CYP £100 000 before his or her license is issued by the Cyprus Real Estate Council.

In this case the law provides for disciplinary penalties against the Cyprus Estate Agent by the council which includes suspension of his or her license reprimand and even being struck off the Cyprus Real Estate Agents register.

Do not do business with any estate agent that does not have a license. Also remember that a real estate license is issued only to individuals and not to legal entities such as a company.

A very important aspect for you to remember when dealing with an estate agent is that if he or she has been the effective cause of the sale he or she will be entitled to commission. So if you have been taken to view the property, given the property information etc. you cannot then by-pass the estate agent and go direct to the Seller and conclude the deal between you hoping for the Seller to avoid paying the commission. In the absence of an agreement to the contrary the seller will be liable to pay the commission to the estate agent. There is thus an obligation on you to tell the Seller of the estate agents involvement. Purchasers must buy with clean hands.
